Payment Terms
Version Betalningsvillkor från 2026-10-27
Payment Terms (Sellers resident in Sweden) v 1.8 - last amended August 2026
These Terms ("Terms") apply in addition to the other rules and terms governing Tradera's Platform when you, in your capacity as a buyer ("Buyer") purchase and pay for goods and/or services from a seller resident or incorporated in Sweden ("Seller"), or in your capacity as a Seller sell and receive payment for goods and/or services on Tradera's Platform. The Terms constitute, together with Tradera's applicable user agreement ("Tradera's User Agreement") and the applicable price list the collective framework agreement for Tradera's payment services.
For sales where the Seller is resident or incorporated abroad, the Terms for Payments (Sellers abroad) shall apply instead. Click here for those terms.
1. Definitions
In these Terms, the following terms shall have the meanings set out below:
"Klarna" means Klarna Bank AB, reg. no. 556737-0431.
"Credit Facility" means the funds that Tradera temporarily makes available to the Seller via the Tradera Balance in connection with payment methods involving a technical processing delay, pending receipt of the Buyer's payment on Tradera's client funds account. The Credit Facility constitutes a fee- and interest-free advance of the sales proceeds and does not entail any credit costs for the Seller.
"Buyer" means a natural or legal person resident or incorporated in or outside Sweden who makes a purchase from a Seller on Tradera's Platform.
"My Tradera" means the user profile provided by Tradera where the user manages, inter alia, their purchases, sales, payout settings and dispute resolution.
"Seller Rules" means the rules that a Seller must always comply with when selling on Tradera's Platform.
"Seller" means a natural or legal person resident or incorporated in Sweden who sells goods or services on Tradera's Platform.
"Tradera" means Tradera Marketplace AB, reg. no. 556569-4642, Solnavägen 3H, 113 63 Stockholm. Tradera is a Swedish licensed payment institution under the supervision of the Swedish Financial Supervisory Authority (Finansinspektionen).
"Tradera Balance" means a payment account in Tradera's name, linked to the Seller's account on Tradera's Platform, to which funds received by Tradera (or advanced via the Credit Facility) for goods sold are credited. The Tradera Balance is an internal payment account for the management of sales proceeds and does not constitute a bank account; accordingly, funds held in the balance are not covered by the statutory deposit guarantee scheme and do not generate interest. Funds in the Tradera Balance may be used by the Seller for their own purchases on the platform or requested to be paid out to an external bank account or PayPal account. The user may not make their own deposits to the Tradera Balance.
"Tradera's User Agreement" means Tradera's terms and conditions for use of Tradera's Platform and other services as applicable from time to time, available here.
"Tradera's Checkout" means the interface in the checkout on Tradera's Platform through which the Buyer is offered payment via the Tradera Balance as well as the external payment methods available from time to time (e.g. Swish, card, Apple Pay, Google Pay, Klarna and Trustly).
"Tradera's Platform" means the websites, marketplace services and applications provided by Tradera (e.g. www.tradera.com).
"Tradera's Payment Service" means the regulated payment services provided by Tradera pursuant to the Swedish Payment Services Act (2010:751).
"Repayment Amount" means the amount that the Seller is obliged to repay to Tradera upon the reversal of a purchase where funds have already been paid out or credited to the Seller, plus any direct costs/fees associated with the transaction and the return, including return shipping costs and fees charged to Tradera by its external payment service providers in relation to a transaction.
2. About Tradera
Tradera Marketplace AB (e-mail: kundservice@tradera.com) is authorised as a payment institution by the Swedish Financial Supervisory Authority (Finansinspektionen) (Box 7821, 103 97 Stockholm, finansinspektionen@fi.se). Tradera holds a licence to provide the execution of payment transactions (including via credit facility) pursuant to the Swedish Payment Services Act (2010:751) ("PSA").
3. Tradera's Payment Services
Tradera provides payment services to enable Sellers to receive payments and, to the extent the Buyer pays using their own Tradera Balance, to enable the Buyer to execute such a payment. Depending on the chosen payment method and the Seller's settings, the service is provided in one of the following ways:
3.1 Payment to Tradera Balance (direct payment)
When the Buyer pays using, for example, Swish, Tradera receives the funds in its client funds account and makes them immediately available to the Seller as a credit to the Seller's Tradera Balance. The funds are subject to a standing payment order and are automatically paid out to the Seller's registered payout account within a maximum of thirty (30) days from the date on which the most recent payment was received, unless the Seller has previously requested a payout or used the balance for purchases on the platform.
3.2 Payment to Tradera Balance (with Credit Facility)
Where payment is made using external payment methods that involve a technical processing delay before the funds actually reach Tradera's client funds account, Tradera credits the Seller's Tradera Balance immediately upon purchase by means of a Credit Facility, so that the Seller has access to their funds without delay. These funds are likewise subject to the standing payment order for automatic payout within a maximum of thirty (30) days from the most recent payment received, unless the Seller has previously requested a payout or used the balance for purchases on the platform.
3.3 Common provisions for the Tradera Balance
All received client funds are held protected in segregated client funds accounts until payout is made or the balance is utilised. Funds in the Tradera Balance may be used by the Seller for their own purchases on the platform or requested to be paid out. The user may not make their own deposits to the Tradera Balance. Regardless of the payment method or currency used by the Buyer at the time of payment in the checkout, the Seller's Tradera Balance is always credited in Swedish kronor (SEK) after the funds have been converted by the relevant payment partner.
4. Formation of agreement, language and access to terms
The Terms and Tradera's User Agreement are entered into in Swedish. Communication between Tradera and the user, including customer service, is provided primarily in Swedish and secondarily in English, via e-mail and/or messages in "My Tradera". In the event of any discrepancy between the Swedish version of these Terms and any translation thereof, the Swedish version shall prevail. Throughout the term of the agreement, you are entitled to request these Terms and the associated pre-contractual information in paper form or on another durable medium (e.g. as a downloadable PDF).
5. Payment in Tradera's Checkout, authorisation and allocation of liability
5.1 Provision of payment methods
When a Buyer makes a payment on Tradera's Platform, payment is offered via the Tradera Balance as well as the external payment methods available from time to time in Tradera's Checkout (which may include, for example, Swish, card payment, Apple Pay, Google Pay, Klarna and Trustly). The current range of payment methods is displayed directly in the checkout on Tradera's Platform.
Where payment is made using external payment methods, the transfer of funds from the Buyer's account or payment instrument to Tradera's client funds account is provided by the Buyer's bank and/or the relevant external payment providers, which are subject to the supervision of the Swedish Financial Supervisory Authority or an equivalent foreign supervisory authority. The Buyer may, in connection with the payment, be required to enter into a separate agreement with the relevant provider and accept its terms and conditions. Any currency conversion in the event of payment in a currency other than SEK shall in such case be carried out by the external payment provider in accordance with its terms and conditions; Tradera does not provide currency conversion services to the Buyer.
Tradera reserves the right to amend, add or remove available external payment methods in Tradera's Checkout, or to change the providers of such payment services, at any time. A Seller is not entitled to charge the Buyer for the opportunity to use Tradera's Checkout.
5.2 Allocation of liability upon payment
Questions, delays or inaccuracies arising in connection with the payment and transfer stage in the checkout (before the payment has actually been received on Tradera's client funds account or confirmed) shall in the first instance be handled between the Buyer and the chosen payment provider or the Buyer's bank. Tradera's liability as a payment service provider in respect of external payment methods arises when the Buyer's payment has been received on Tradera's client funds account or when Tradera confirms the transaction and makes the Credit Facility available. Tradera is thereafter responsible for its payment service, meaning that it shall immediately credit the funds to the Seller's Tradera Balance and safeguard the client funds in a segregated account in accordance with applicable legislation. Where payment is made by transfer from the Buyer's own Tradera Balance, Tradera is responsible for the execution of the transaction in its entirety.
5.3 Specific provisions regarding payment via Klarna
Where the Buyer chooses to pay via Klarna, the Seller assigns to Tradera the right to receive payment from the Buyer, and Tradera in turn assigns the claim to Klarna. The Buyer accepts that payment for the purchased item shall be made to Klarna and that the payment obligation can only be discharged with releasing effect by payment to Klarna (and not to Tradera or the Seller). The assignment of the claim to Klarna does not, however, affect Tradera's obligations towards the Seller under these Terms. The Seller may not direct any payment claims against Klarna; in this case too, it is Tradera (in its capacity as the Seller's payment service provider) that is responsible for making the funds available to the Seller in accordance with sections 3 and 6.
5.4 Information required for the correct execution of payment orders
For a payment order to be executed correctly, the following information must be provided:
- When paying with Tradera Balance: The Buyer must be logged in to their user account on Tradera and must approve and verify the transfer from the balance in the checkout.
- When paying with external payment methods: The Buyer must provide the information required (e.g. telephone number for Swish or card details) and complete the verification required by the chosen external payment provider.
- Upon payout/sale: The Seller must have a registered user account on Tradera and must register their account details, PayPal e-mail address or bank account under their profile settings in My Tradera.
Tradera shall not be liable for delayed or failed transactions resulting from your having provided incorrect or incomplete information.
5.5 Authorisation of payment orders
A payment order is deemed authorised by the Buyer when the Buyer completes the payment step in Tradera's Checkout and verifies the transaction using the authentication method required for the chosen payment method.
5.6 Revocation of payment orders
Once the Buyer has authorised the payment order and the transaction has been confirmed in the checkout, the payment order is final and cannot be revoked by the Buyer. For any return, right of withdrawal or dispute regarding a purchased item, reference is made to Tradera's Buyer Protection in section 12 and applicable consumer sales law.
5.7 Seller's obligation to deliver upon confirmed payment
The Seller is obliged, after Tradera has confirmed that the Buyer has made payment for the entire order, to dispatch or hand over the item to the Buyer without delay and no later than within the time limit (normally within seven (7) days) set out in the listing, the payment confirmation or Tradera's Seller Rules as applicable from time to time.
6. Execution of payments and payout timescales
6.1 Time of receipt
A payment order is deemed received by Tradera at the time at which the checkout confirms that the transaction has been approved by the payment provider.
6.2 Payout frequency, registered account and automatic payout
The Seller may, in their profile settings, choose whether payouts of funds in the Tradera Balance shall be made automatically on a weekly basis (on Thursdays) or monthly (on the 25th of the month). If the chosen payout date falls on a public holiday or bank holiday, the payout shall be processed on the next business day. In order to receive payouts, the Seller must register their account details, Swish number or PayPal account, which must belong to and be held in the Seller's own name. Tradera reserves the right to verify account ownership and to refuse payouts to third parties. If the Seller has chosen payout via PayPal, the payout transaction is provided in cooperation with PayPal's payout service (Hyperwallet) in accordance with section 17.
If the Seller does not make an active choice, or if no new transactions or manual payout requests have occurred, the Tradera Balance is subject to a standing payment order. This means that Tradera will execute an automatic payout of the entire available Tradera Balance to the Seller's registered bank account, Swish number or PayPal account within a maximum of thirty (30) days from the date on which the most recent payment was received by Tradera, unless the Seller has previously used the balance for purchases on the platform or provided a different payout instruction.
6.3 Cut-off time for payouts
Requested, scheduled or automatic payouts from the Tradera Balance to the Seller's bank account are processed on business days. Tradera's principal cut-off time, at which a payment order for a payout is deemed received on the same business day, is 10:30 a.m. Payout instructions received, scheduled or falling after 10:30 a.m. or on a weekend or public holiday shall be processed at the next regular payout run on the following business day. The time at which paid-out funds are available in the Seller's account thereafter depends on the processing times of the receiving bank.
6.4 Maximum execution time
- Credit to Tradera Balance: Occurs immediately upon approved payment in the checkout, regardless of payment method, including card and credit payments covered by the Credit Facility.
- Payout to bank account (payout of Tradera Balance): The transfer from Tradera's client funds account to the Seller's registered bank account is completed no later than the next business day after the payout instruction has been processed at the cut-off time.
- Payout via PayPal: Once Tradera has processed the payout instruction at the cut-off time, the instruction is transferred to Hyperwallet for payout to the Seller's PayPal account. The payout is completed within a maximum of four (4) business days after the payout instruction has been processed at the cut-off time.
7. Fees, pricing and set-off
7.1 Payment service fees
Tradera's payment services (including the provision of the Tradera Balance and the Credit Facility) are free of charge for both Buyers and Sellers. No interest, set-up, monthly or annual fee is charged for the use of the payment solution or the Credit Facility.
7.2 Marketplace fees and set-off
Tradera charges commission and supplementary fees for use of the marketplace in accordance with the applicable price list. Tradera is entitled to set off the Seller's outstanding fees payable to Tradera (e.g. sales commission, buyer protection fee or return shipping) directly against the Seller's Tradera Balance or in connection with a payout.
7.3 Negative Tradera Balance and recovery
If the Seller's Tradera Balance becomes negative, for example as a result of a transaction being reversed under the Buyer Protection, a Buyer exercising their statutory right of withdrawal, or a card payment being reversed after a payout has already been made to the Seller, an immediate claim arises for Tradera against the Seller corresponding to the Repayment Amount. Tradera is entitled to settle the negative balance by setting off the amount against existing or future payments to the Seller's Tradera Balance, or by invoicing the Seller for the amount with the payment period stated on the invoice.
8. Security, strong customer authentication and incidents
8.1 Strong Customer Authentication (SCA)
Tradera applies strong customer authentication and the requisite security controls in accordance with applicable legislation (e.g. upon registration of a payout account, amendment of sensitive account details and upon initiation of payment services where required by law or Tradera's security procedures). Authentication is carried out using the verification methods indicated by Tradera on the relevant occasion.
8.2 Obligation to protect login credentials
You are responsible for all actions taken through the use of your unique login to Tradera. You are obliged to protect your login credentials and keep them confidential.
8.3 Notification of unauthorised use
If you suspect that your login or your Tradera Balance has been used without authorisation, you must immediately notify Tradera's customer service or send an e-mail to abuse@tradera.com.
8.4 Information on security risks and incidents
Tradera informs users of known security risks (e.g. phishing) on its help pages. In the event of a serious operational or security incident that may affect users' financial interests, Tradera will without delay inform affected users via e-mail and/or messages on the platform with information about the incident and appropriate protective measures.
9. Blocking of Tradera Balance and payment service
Tradera reserves the right to block the use of the Tradera Balance or to stop/withhold a payout to the Seller if:
- There are reasonable grounds to suspect unauthorised or fraudulent use.
- It is required by law (e.g. suspicion of money laundering or financing of terrorism).
- The transaction may reasonably be suspected to involve the Seller breaching applicable law, or a claim arising against a person who may reasonably be assumed to share a financial interest with the Seller.
- The transaction involves the Buyer acquiring cash (e.g. currency exchange or cheques).
- The Seller materially breaches these Terms, the User Agreement, the Seller Rules or the terms of the Seller Protection.
- It occurs within the framework of an escalated dispute resolution case under the Buyer Protection.
- Transactions where the Buyer, in their capacity as a consumer, has exercised their statutory right of withdrawal against a Seller conducting commercial activity.
Tradera shall notify the user of the blocking and the reasons therefor before the blocking takes effect or immediately thereafter, unless such notification would compromise security considerations or is prohibited by law.
10. Liability for unauthorised and incorrectly executed payment transactions
10.1 Notification period
If a transaction has been executed without authorisation or incorrectly, you must notify Tradera as soon as possible after becoming aware of the event, and no later than within thirteen (13) months of the date on which the amount was debited or credited. If you delay in notifying Tradera after becoming aware of the error, or if more than thirteen (13) months have elapsed, you forfeit your right to rectification. Notification and complaints must be made in writing to Tradera by e-mail to abuse@tradera.com.
10.2 Tradera's liability for incorrectly executed transactions
If Tradera is liable for an incorrectly executed or delayed transaction, Tradera shall without undue delay restore the Tradera Balance or execute the payout correctly.
10.3 Unauthorised transactions and excess
In the event of an unauthorised payment transaction, Tradera shall refund the amount to you without delay and no later than by the end of the business day following the day on which Tradera became aware of the transaction. If Tradera has reason to suspect that the transaction was authorised or that you have acted fraudulently, Tradera is nevertheless entitled to a reasonable period of time to investigate the matter before making the refund.
If the unauthorised transaction was able to be executed because you failed to protect your personalised security credentials (e.g. login details or electronic identification), the following shall apply:
- Liability up to SEK 400: If unauthorised transactions have been executed as a result of your failure to protect your personalised security credentials, you are liable for the full amount, up to a maximum of SEK 400.
- Liability in cases of gross negligence and particularly reprehensible conduct: If you, as a consumer, have through gross negligence failed to protect your personalised security credentials, you are liable for the full amount, up to a maximum of SEK 12,000. If you, as a consumer, have acted in a particularly reprehensible manner, you are liable for the full amount. If you, as a business, have through gross negligence failed to protect your personalised security credentials, you are liable for the full amount.
Tradera bears the entire loss for unauthorised transactions executed after you have notified Tradera that your account or login credentials are to be blocked, unless you have acted fraudulently or dishonestly. You are not liable for any amount charged to the account if strong customer authentication was not required when the unauthorised transaction was initiated. This does not apply, however, if you have through fraudulent conduct contributed to the unauthorised transaction.
11. Know Your Customer
As a payment institution, Tradera is obliged to comply with the applicable legislation and regulations on measures against money laundering and the financing of terrorism. For the purpose of complying with applicable anti-money laundering and counter-terrorism financing provisions, Tradera may request information from Buyers and Sellers in order to, inter alia, establish identity and the purpose of use of Tradera's payment service. Furthermore, transactions carried out by Buyers and Sellers will be subject to Tradera's transaction monitoring. By using Tradera's payment service, Buyers and Sellers undertake to provide all such information as may be deemed necessary for these purposes. Failure to comply with such a request may result in Tradera refusing to provide the payment service.
12. Buyer Protection and Seller Protection
12.1 Buyer Protection and Dispute Resolution
Scope: Under certain conditions, a Buyer has the benefit of buyer protection, which means that the Buyer may have disputes handled and receive a refund of the amount paid in a transaction. The maximum refundable amount permitted under Tradera's buyer protection is SEK 50,000.
Availability: Whether buyer protection is included depends on the payment method chosen, the item price, the delivery method, and whether the buyer resides in Sweden:
- Payment with Klarna: Buyer protection is always mandatory.
- Other payment methods (Swish, card payment, etc.): Buyer protection is included for a fee and is mandatory when shipping. For a Swedish buyer, buyer protection is optional if:
- The order's item value is below SEK 200,
- The buyer chooses collection, or
- The purchase is made from a Swedish business (for foreign buyers, buyer protection is mandatory even when purchasing from Swedish businesses).
Whether buyer protection is mandatory or optional (and any applicable fee) is shown at checkout before the payment method is selected. When buyer protection is included in a purchase, the seller is obligated to follow the applicable terms for buyer protection.
Exclusions from buyer protection: The following purchases are never covered by Tradera's buyer protection:
- Purchases of real property (including residential property);
- Purchases of vehicles (motor vehicles, motorcycles, caravans, aircraft and boats), except for private portable, lightweight recreational vehicles (e.g. bicycles and hoverboards);
- Purchases of customised items (unless the recipient claims that the items have not been received);
- Purchases of items equivalent to cash (including, without limitation, gift cards);
- Purchases of tickets to events (e.g. sports or concert tickets); and
- Purchases of goods and services that are prohibited under Tradera's Seller Rules.
Dispute resolution procedure: If a Seller and a Buyer have a disagreement (e.g. non-delivery or the item differing materially from the description), the parties may resolve their disagreement through the dispute resolution system in My Tradera. The dispute must be initiated within 30 days of the purchase and all communication must take place via the system. If the parties do not reach a resolution within ten (10) days, the Buyer may escalate the dispute to Tradera. If the dispute is not escalated within 10 days, it is automatically closed in the Seller's favour. The Seller is obliged to respond to the Buyer's complaint without delay and to provide the requested documentation. If the Seller fails to submit the requested documentation within the stipulated time, Tradera may decide the matter in the Buyer's favour based on the available documentation.
Decision and return: If the dispute is resolved in the Buyer's favour, Tradera may require that the item be returned to the Seller or to Tradera before a refund is made. The Seller is obliged to collect the returned item within the carrier's timeframe. If the Seller does not collect the item, Tradera will store it for up to one (1) month, after which Tradera is entitled to determine ownership. Tradera is entitled to charge the Seller a handling fee in accordance with the applicable price list for uncollected buyer returns. If a refund has been made to the Buyer and Tradera has an outstanding claim against the Seller for the Repayment Amount, Tradera reserves the right to retain the item until the Seller's debt to Tradera has been settled in full.
Tradera's decision in a matter cannot be appealed to Tradera, but the parties are free to seek a different resolution in another forum.
12.2 Seller Protection
Scope: Under certain conditions, a Seller is entitled to Tradera's seller protection, which means that the Seller may retain the payment received even if the Buyer claims that the item has not been received or does not conform to the description.
Exclusions: The same product categories excluded from buyer protection under section 12.1 are also excluded from seller protection.
Conditions for seller protection: For seller protection to apply, the following conditions must be met:
- The Seller dispatches the item to the delivery address approved by Tradera at the time of payment. If the Buyer's delivery address has been changed after the purchase has been completed, Tradera will notify the Seller of this in the e-mail confirmation sent when the Buyer has paid for the item, and the information will also be available in My Tradera.
- Items with a price exceeding SEK 200 must have been handed over to the Buyer by the Seller or by an engaged carrier in order for the Seller to be covered by seller protection. If the Buyer claims that they have not received the delivery, Tradera will ask the Seller for documentation proving that the Seller, or the engaged carrier, has delivered the items to the Buyer. Tradera therefore recommends that Sellers send items with tracking, e.g. a tracking number from the carrier.
- The Seller chooses a shipping method under which the items are insured up to the value of the items.
- The Seller must describe all items in the listing adequately in text and through photographs so that the Buyer can inspect the item and its condition before entering into the purchase agreement with the Seller. The Seller must also deliver the items to the carrier in the same condition as described in the listing.
- The Seller must have dispatched the items to the Buyer in an appropriate manner, meaning that delivery must take place by packaging and sending all ordered items in a manner that minimises the risk of the products being damaged.
If the Buyer claims not to have received the delivery, Tradera will ask the Seller for documentation proving that the Seller, or the engaged carrier, has delivered the items to the Buyer. Tradera therefore recommends that Sellers dispatch items with tracking, e.g. a tracking number from the carrier.
- The Seller selects a shipping method under which the items are insured up to the value of the items.
- The Seller must describe all items adequately in text and through photographs in the listing so that the Buyer can examine the item and its condition before entering into the purchase agreement with the Seller. The Seller must also deliver the items to the carrier in the same condition as described in the listing.
- The Seller must have dispatched the items to the Buyer in an appropriate manner, meaning that delivery must be effected by packaging and dispatching all ordered items in a manner that minimises the risk of damage to the products.
12.3 Right to refund for unknown amount
If you have authorised a payment to be made but the exact amount was not specified at the time of authorisation, you are entitled to a refund from Tradera if the amount debited was higher than you could reasonably have expected.
A request for a refund must be made to Tradera within eight (8) weeks of the date on which the amount was debited from your account. Tradera will investigate the matter and, within ten (10) business days, either refund the amount or notify you of the reasons for refusing the refund and how you may take the matter further. (If it subsequently transpires that you were not entitled to the refund, you will be obliged to repay the amount to Tradera.)
For ordinary returns, non-delivery or defects in the item, the rules for Buyer Protection in section 12.1 shall apply instead.
13. Intellectual property rights
Tradera reserves ownership of all intellectual property rights in everything developed by Tradera to which the user has access under the Terms and on Tradera's Platform. The user undertakes in particular never to use signs, logotypes, symbols or other elements that could be confused with Tradera's trademarks.
14. Personal data
Tradera's Privacy Policy as applicable from time to time applies to personal data processed by Tradera in connection with these Terms. Personal data is also processed independently by external payment providers in accordance with their respective privacy policies when their services are used.
15. Term, termination and force majeure
15.1 Term
The Terms apply until further notice from the date on which you begin using Tradera's payment service.
15.2 Termination by the user
You may terminate the Terms at any time with immediate effect and without cost via the settings on Tradera's website or by written notice to Tradera. Please note that termination of the Terms means that you will no longer be able to buy, sell or execute transactions on Tradera's Platform, and that your account on Tradera will accordingly be closed. Final closure of the account is conditional upon you having no active bids or ongoing transactions, and all outstanding invoices, fees and debts to Tradera being paid in full. Tradera reserves the right to retain certain information even after the account has been closed to the extent required by law (e.g. accounting and anti-money laundering legislation).
15.3 Termination by Tradera
Tradera may terminate the Terms in writing by e-mail with a minimum notice period of two (2) months. Upon termination, Tradera is entitled to withhold payouts until outstanding transactions have been verified and all withdrawal or dispute periods have expired.
15.4 Force Majeure
Neither the Buyer, the Seller nor Tradera shall be held liable for failure to perform or delayed performance if the cause is a lightning strike, sabotage, governmental action, power failure, disruption of the internet or telecommunications, or any other event beyond the party's reasonable control. The foregoing applies for as long as such a force majeure event continues. The party invoking force majeure is obliged to take reasonable measures to limit the damage caused by the event. If the force majeure event continues for more than sixty (60) days, each party is entitled to terminate the Terms.
16. Amendments to the Terms
Tradera is entitled to propose amendments to these Terms. Amendments are notified to the user by e-mail or message in My Tradera no later than two (2) months before they are proposed to take effect. In the event of any conflict between these Terms and Tradera's User Agreement with respect to notice periods for amendments to the payment service, these Terms shall prevail. If you do not accept the amended terms, you are entitled to terminate the Terms immediately and without charge before the date on which the amendments take effect. If you do not notify Tradera of your objection to the amendments before the date of entry into force, you shall be deemed to have accepted the new terms.
17. Tradera's partners
In the exceptional cases where a Seller has been directed to or granted payout via PayPal, the payout service is provided in cooperation with PayPal (Europe) S.à r.l. et Cie, S.C.A. through its payout solution Hyperwallet. By using Tradera's payment solution and selecting PayPal as the payout method, the Seller also accepts the terms and conditions of Hyperwallet (User Agreement and Privacy Policy available on Hyperwallet's website). The Seller accepts that Tradera may transfer the necessary account and transaction details to PayPal/Hyperwallet for the purpose of executing the payout and complying with applicable regulations.
18. Questions, complaints and dispute resolution regarding the payment service
18.1 Right to lodge a complaint regarding the payment service
If you are dissatisfied with Tradera's payment services, for example in relation to an executed payment, an incorrect Tradera Balance, the allocation of a Credit Facility, a delayed payout, an incorrectly executed transaction or the execution times applied, you are entitled to lodge a formal complaint with Tradera.
18.2 How to lodge a payment service complaint
Complaints regarding the payment service must be submitted in writing to Tradera's complaints officer. You may lodge your complaint via:
- E-mail: kundservice@tradera.com (please state "Payment Service Complaint" in the subject line)
- Chat: The chat function when logged in to Tradera's Platform
- Post: Tradera Marketplace AB, Att: Complaints Officer, Solnavägen 3H, 113 63 Stockholm
18.3 Handling and response times
Tradera handles received payment service complaints promptly, impartially and free of charge. Tradera will provide a written and reasoned response to your complaint on a durable medium (e-mail) as soon as possible and no later than within fifteen (15) business days of receipt of the complaint. If, in exceptional circumstances, Tradera is unable to respond to the complaint within 15 business days due to reasons beyond Tradera's control, Tradera will send a provisional response explaining the reasons for the delay and indicating when a final response will be provided at the latest (in any event no later than within 35 business days).
18.4 External review bodies and consumer guidance
If you are not satisfied with Tradera's decision in a complaint matter relating to the payment service, you as a consumer are entitled to have the dispute reviewed outside of court by:
- The National Board for Consumer Disputes (ARN): Box 174, 101 23 Stockholm, www.arn.se. Applications to ARN must be made within the applicable time limits.
- Konsumenternas Bank- och Finansbyrå (the Swedish Consumers' Banking and Finance Bureau): You can obtain free guidance and information via www.konsumenternas.se or by telephone on 0200-22 58 00.
- Municipal consumer advisory services: Free guidance in your municipality of residence.
18.5 Disputes regarding purchased items (Buyer Protection)
Please note that complaints and disagreements relating to the purchased item, the delivery or the Seller's description constitute a commercial law dispute between the Buyer and the Seller. Such disputes are not handled as a payment service complaint under the above procedure, but must be initiated and reviewed through Tradera's dispute resolution procedure for Buyer Protection under section 12.
18.6 Applicable law and jurisdiction
The Terms shall be interpreted and applied in accordance with Swedish law. Disputes regarding the payment service may always be determined by a Swedish general court, with the Stockholm District Court as the court of first instance.
