DETAILED TERMS OF SALE — TROPICAL PLANTS ????
Terms valid for the sale and shipment of live plants through any online sales service.
1) SELLER ??
Sale made by a private seller.
2) COMMUNICATIONS AND SAFETY ????
All purchase-related communications must take place exclusively through the internal messaging system of the service used for the order. No off-service agreements, payments, contact exchanges, or side deals will be handled.
3) PLANT IDENTITY — PHOTO = PLANT SOLD ???
The plant shown in the photos is exactly the plant for sale and the one that will be shipped. Unless explicitly stated otherwise in the listing, images are not sample photos: what you see is what you buy (same plant, same specimen).
4) NATURE OF THE PRODUCT — LIVE PLANTS ??
Plants are living organisms. During and after transit, normal physiological changes may occur and are not necessarily defects, such as: slight loss of turgor, minor movement marks, temporary leaf droop, mild yellowing, stress from environmental change, and temporarily slowed growth.
5) VARIEGATION, COLOR, AND APPEARANCE ??
If the plant is variegated, variegation may change over time, including new leaves showing more or less variegation, depending on genetics, light, temperature, stress, and acclimation. Colors, patterns, and variegation intensity may also change after repotting or during post-transit recovery. Size, leaf count, and growth rate may naturally vary.
6) PLANT CONDITION AT THE START OF SHIPPING ???
The plant is shipped in a condition considered suitable for transport. Any cosmetic imperfections, pre-existing marks, older leaves with minor damage, scars, or specific growth-point characteristics must be considered part of natural variability and/or described in the listing when relevant.
7) SHIPPING METHOD ????
Shipping may be carried out:

In pot: with slightly dry substrate and the plant secured to reduce movement;

Bare-root: with roots protected and moisture managed to reduce the risk of rot during transit.

The method is chosen to improve safety and reduce risk depending on the species, weather conditions, and plant stability.
8) PACKAGING AND PREPARATION ?????
The plant is packed with appropriate protection and stabilization materials (shock-absorbing materials, leaf/stem protection, pot fixation, or root protection) to limit impacts and movement. If preventive treatments are applied, they are intended only to reduce the risk of rot and/or pests during transit and do not constitute a guarantee of total absence of problems.
9) ADDRESS, AVAILABILITY, AND COLLECTION — BUYER’S OBLIGATIONS ???
The buyer is responsible for providing a complete and correct address, including name, street number, postal code, and any useful delivery details, and for being available to receive the parcel. Unavailability, failed delivery attempts, storage delays, or late pickup significantly increase the risk of plant stress or damage and are not attributable to the seller.
10) TRANSIT RISK AND LIMITATION OF LIABILITY ????
Once the parcel has been handed over to the carrier, the seller can no longer control transport conditions such as shocks, temperatures, transit times, storage conditions, tipping, pressure, or humidity. The seller is not responsible for delays, external events such as weather disruptions, logistics issues, strikes, or the carrier’s operational handling.
11) ARRIVAL INSTRUCTIONS — BUYER’S RESPONSIBILITY ????
Upon arrival, it is recommended to:

inspect the parcel immediately and open it carefully;

acclimate the plant for 24–48 hours in bright light without direct sun;

avoid cold temperatures and sudden temperature changes;

avoid immediate heavy watering;

if shipped bare-root, repot into a well-draining mix and wait 24–48 hours before watering, if needed.

Damage caused by improper post-delivery care, including direct sun exposure, cold, overwatering, unsuitable substrate, immediate fertilizing, or aggressive repotting, is not attributable to the seller.
12) ANTI-FRAUD CLAUSE — MANDATORY “NO CUT” UNBOXING VIDEO ????
For any refund and/or replacement request concerning issues found upon arrival, including shipping damage, wrong plant, or mismatch with the photos or description, the buyer must provide:

a full, continuous no-cut video clearly showing:

the parcel still sealed;

the shipping label visible;

the opening of the parcel;

the removal of all protective materials;

the extraction of the plant;

close-up details of leaves, stem, and roots/substrate;

supporting photos of:

the shipping label;

the outer box;

the inside packaging;

the specific issue or damage.

This material must be sent within 2 hours of delivery, or immediately upon receipt if delivery takes place in the evening.
?? Purpose: to prove that the plant was not replaced or tampered with during unboxing and that the reported issue is compatible with transit or with what was actually received.
Without the required no-cut video and supporting photos, the seller does not guarantee seller-managed refunds or replacements, except where mandatory applicable law and/or the rules of the sales service require otherwise.
13) RETURNS AND LIVE PLANTS ????
Returns of live plants are not accepted, except where required by mandatory applicable law and/or by the rules of the sales service used.
14) ORDER CANCELLATION FOR FRAUD RISK ????????
The seller reserves the right to cancel an order before shipment where there are objective indicators of fraud risk, including inconsistent information, abnormal requests, or attempts to move agreements outside the sales service.
15) PREVALENCE OF THE SALES PLATFORM RULES ??
If there is any conflict between these conditions and the rules or terms of the sales service used, the rules or terms of that service shall prevail.
